1. Acceptance of Terms
These Terms and Conditions (the “Terms”) govern your access to and use of the website located at purestreamwatersolutionsnwf.com (the “Site”) and any request for services submitted to Pure Stream Water Solutions NWF (“Pure Stream,” “we,” “us,” or “our”). By accessing the Site or submitting a request, you agree to be bound by these Terms. If you do not agree, do not use the Site.
2. No Contract Formed by Website Submission
Submitting a booking or quote request through the Site is a request for information only. It does not create a binding contract, reserve a service date, or obligate Pure Stream to perform any work. A contract for services is formed only upon a written proposal, work order, or agreement signed or otherwise expressly accepted by both parties.
3. Estimates, Pricing, and Site Conditions
Prices, depths, timelines, and other figures provided by phone, email, or on the Site are estimates based on information available at the time and on typical conditions in the service area. Subsurface conditions cannot be fully known in advance. Actual well depth, casing requirements, water quantity, water quality, materials, and labor may differ materially. Additional charges may apply for unforeseen conditions including but not limited to rock formations, borehole collapse, contamination, obstructed or unmarked utilities, access limitations, or added permitting requirements. Any change in scope or price will be communicated to you before the additional work is performed whenever reasonably practicable.
4. No Guarantee of Water Quantity or Quality
Pure Stream does not warrant or guarantee that any well will produce water in any particular quantity, at any particular flow rate, or of any particular quality, nor that water will remain available or of consistent quality over time. Groundwater conditions are natural and variable. Charges for drilling, casing, materials, and labor are earned and payable regardless of the yield or quality of water encountered, unless expressly agreed otherwise in writing.
5. Customer Responsibilities
You represent that you own the property where work is to be performed or are authorized to permit the work. You are responsible for providing safe and adequate access for equipment, disclosing the location of septic systems, drain fields, irrigation lines, private utilities, and other buried improvements, and obtaining any homeowners association or landlord approvals. Pure Stream is not liable for damage to lawns, driveways, landscaping, or undisclosed or unmarked private underground facilities arising from ordinary access and performance of the work.
6. Scheduling, Cancellation, and Payment
Service dates are estimates and may be affected by weather, equipment availability, permitting, and prior jobs. Unless otherwise stated in writing, invoices are due upon completion of the work. Amounts not paid when due may accrue interest at the maximum rate permitted by Florida law, and you agree to pay reasonable costs of collection, including attorneys' fees. Pure Stream reserves any lien rights available under Florida law, including under Chapter 713, Florida Statutes.
7. Warranty
Pure Stream warrants that its workmanship will be performed in a good and workmanlike manner consistent with industry standards. Equipment such as pumps, tanks, and filtration components carries only the warranty offered by its manufacturer, which is passed through to you to the extent permitted. EXCEPT AS EXPRESSLY STATED, PURE STREAM DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Warranty coverage does not apply to damage caused by misuse, neglect, lightning, power surge, freezing, flooding, sediment or mineral fouling, alteration or repair by others, or changes in groundwater conditions.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURE STREAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOSS OF USE, LOSS OF WATER SERVICE, CROP OR LIVESTOCK LOSS, OR PROPERTY DIMINUTION, ARISING OUT OF OR RELATING TO THE SITE, THE SERVICES, OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PURE STREAM'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO ANY PROJECT SHALL NOT EXCEED THE AMOUNTS ACTUALLY PAID BY YOU TO PURE STREAM FOR THAT PROJECT. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
9. Site Content and Intellectual Property
All content on the Site, including text, graphics, images, logos, and software, is owned by Pure Stream or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site without our prior written permission. Site content is provided for general informational purposes only and does not constitute engineering, geological, legal, or health advice.
10. Acceptable Use
You agree not to use the Site to submit false, misleading, or unauthorized information; to transmit malicious code; to attempt to gain unauthorized access to our systems; to scrape or harvest data; or to interfere with the operation of the Site.
11. Disclaimer
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SUBMISSION WILL BE RECEIVED OR ACTED UPON. 12. Indemnification
You agree to indemnify, defend, and hold harmless Pure Stream and its owners, employees, and subcontractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misrepresentation of property ownership or site conditions, or your violation of applicable law.
13. Force Majeure
Pure Stream shall not be liable for any delay or failure to perform caused by events beyond its reasonable control, including weather, hurricanes, flooding, acts of God, labor or material shortages, utility or permitting delays, equipment failure, or governmental action.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. The parties agree to attempt in good faith to resolve any dispute informally before initiating proceedings. Any action arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Northwest Florida, and you consent to the personal jurisdiction of those courts. Any claim must be brought within one (1) year after the cause of action accrues, to the extent permitted by law.
15. Severability, Waiver, and Entire Agreement
If any provision of these Terms is held unenforceable, that provision will be limited or severed and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with any signed proposal or work order and our Privacy Policy, constitute the entire agreement between you and Pure Stream regarding the subject matter and supersede all prior communications. In the event of a conflict, a signed proposal or work order controls.
16. Changes to These Terms
We may revise these Terms at any time by posting an updated version on the Site. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
